When a Breakup Turned Into a Small Claims Case Over “Love” and Gadgets

I didn’t expect a breakup story to come with a court summons, but that’s exactly what my client brought to my office.



A few weeks after the relationship ended, she received a demand letter from a law firm. Then came the next punch: a small claims case for collection of sum of money. In other breakups I’ve handled, it even escalated into replevin, where one party tries to recover items as if they were stolen or unlawfully withheld.


The accusation was simple: “You owe me for what I gave you!”


And here’s the part people don’t talk about: this pattern isn’t rare. I’ve encountered it more than twice, where love turns into receipts the moment reconciliation is denied.


In one case, it was between two women. One partner “lovebombed” the other: gadgets, expensive gifts, even items given to family members. It looked like generosity. It felt like devotion. Until the relationship ended, and the giver suddenly treated everything as a collectible debt.


So we fought the case on a basic legal truth: a gift given in a romantic relationship is generally gratuitous. If something is given freely out of affection and generosity, it is not presumed to be a loan. To collect money, the claimant must prove a real obligation to pay, not just the fact that they spent.


The court appreciated the context and the logic.


The claims were dismissed.


Here’s the reality check: When you give, give out of love—not as leverage. Your partner is not a hostage to the material things you chose to offer.
